Despite several requests over the last 2 months, Dannenbaum Engineering Corporation (Dannenbaum) has yet to produce even a "progress report" on engineering plans it was to have completed and delivered to the Brownsville Navigation District (BND) under the settlement agreement the parties signed in February 2007.
Dannenbaum has been sued by BND taxpayers for Dannenbaum's breach of the settlement agreement, including its failure to complete the engineering plans for the BND's proposed international bridge. The Plaintiffs motion for summary judgment against Dannenbaum is set for hearing December 18 in the 107th District Court of Cameron County.
The BND first asked Dannenbaum for a progress report on September 5, when Port Director/Chief Executive Officer Eduardo Campirano wrote James Dannenbaum, President & CEO of Dannenbaum Engineering Corporation asking that he provide the BND with a "progress report" that would "outline exactly what has been done to date and what remains to be done."
After a meeting with Dannenbaum principals in late October, BND officials expected to receive the progress report the week of November 5 and full plans by December 31, as reported in the October 29 Brownsville Herald article "BND wants progress report from Dannenbaum."
Port Director/Chief Executive Officer Eduardo Campirano however, confirmed via email November 27, that "no progress report has been submitted to date."
On November 27, Plaintiffs' attorney Peter Zavaletta filed that email as well as the deposition of BND Chief Financial Officer Debbie Duke as additional evidence in support of the plaintiffs' motion for summary judgment.
